The Court of Appeal sitting in Federal Capital Territory, (FCT) Abuja today Wednesday 6th March, 2024 set aside the judgment of the Abuja High Court which restrained the National Chairman of Labour Party (LP), Barr. Julius Abure and two others from parading themselves as national officers of the party.
Ruling on an Ex-parte Application on April 5, 2023, Hamza Muazu, the Presiding Judge, had restrained Abure, Farouk Ibrahim, Clement Ojukwu, and Oluchi Opara from acting as national officers of the the party.
The court also dismissed the objection raised by Abure challenging his removal as chairman of the Labour Party.
The suit which was filed by Martins Esikpali John, Lucky Shaibu, Isah Zekeri, Omogbai Frank, Abokhaiu Aliu, Ayohkaire Lateef, John Elomah, and Ayobami Arabambi accused Abure and others of forging several documents of the FCT High Court to carry out unlawful substitutions in the last elections.
The defendants, however, approached the appeal court for redress.
Delivering the judgement today Wednesday 6th March, 2024, Justice Hamman Barka held that the High Court was wrong to have assumed jurisdiction on the matter.
The presiding judge also awarded N1 million in favour of the Appellants.
Reacting to the Appeal Court judgement, Edo State chairman of Labour Party (LP), Comrade Kelly Ogbaloi said Appeal Court has again stand as an arbitral that cannot be corrupted and congratulated the national chairman of the party, Barr. Julius Abura and the party.
According to him, “I am profoundly elated at that development. Again the Appeal Court has stand out as an arbitral that cannot be corrupted. On the whole, the party and the national chairman have be vindicated that we committed no crime whatsoever that would have warranted a few number of persons coming out, breaking the rules of the party, subverting the constitution of our party to make pronouncement as to the fact that the national chairman is removed and then the Federal High Court in Abuja also trying to held that in a hurry.
“With this treatment, it’s clear that we have return back as solid as we used to be, and that subversion which witchingly created by Apapa and his cohorts will not continue to strive.
“For us at the level of Labour Party, Edo State chapter level, we congratulate ourselves, we congratulate the National Chairman, that the truth has again prove evil wrong.”
Going further, Comrade Ogbaloi assured Edo people that Barr. Julius Abure led National Working Committee is ever ready to tackle the battle ahead in ensuring that the party wins the forthcoming Edo governorship election.
“But again, the judgment still not given at that of our party primary time created some level of impediment in the progressions that we had already placed before ourselves, because tongue wagged to say well, the man is a saint, can he lead to prosecute an election, well he is not there, he is there. But with this, it is clear that the national chairman remain the substantive national chairman of Labour Party. And therefore that has further impetus to us because we have no other exuberance whatsoever other than that which people unduly magnify. With that out of the way, some of our powers has been riveted and we would take in the campaign and everything that comes with it headway.”
